Lenrybprom made a further application to set aside the arrest of their vessel Kommunar. They said that at the time the relevant goods and services were supplied to the vessels Lenrybprom was an unincorporated association (referred to as “POL”) whereas by the time the cause of action arose it had become incorporated, and was now a separate legal entity (referred to as “AOL”).
