VARIOUS ADR techniques are increasingly being used in complex legal cases as a method of brokering agreement. Whilst mediation and conciliation certainly have many advantages for the parties involved and for insurance companies who choose to take advantage of them, they are often unsuccessful in breaking down entrenched positions which often form in complex cases.
