The House of Lords in Customs and Excise Commissioners v Barclays Bank plc [2006] UKHL 28; [2006] 3 WLR 1 considered the circumstances in which the law imposes liability for the negligent infliction of economic loss. While the facts are far removed from the construction industry, the case is of some significance given that economic loss claims do feature in litigation involving the construction industry.
