In John Mowlem Construction plc v Neil F Jones Ltd [2004] BLR 387 the Court of Appeal held that the scope of the defendant solicitors’ retainer did not extend to advising their client about its insurance position. They were retained to recover an outstanding debt and it could not be said that they were under a duty to advise their client of the need to notify their PI insurers of a potential claim.
