DURESS DEFINED

R v Attorney-General for England and Wales [2003] UKPC 22

The doctrine of duress has given rise to some difficulty in its application to construction contracts (see, for example, DSDN Subsea Ltd v Petroleum Geo-Services ASA [2000] BLR 530, discussed in our February 2001 issue, pp.6–8). Some valuable guidance on the scope of the doctrine of duress has recently been provided by the Privy Council in R v Attorney-General for England and Wales [2003] UKPC 22.
