EXEMPLARY DAMAGES: THE ONWARD MARCH CONTINUES

A v Bottrill [2002] UKPC 44

In our January 2002 issue (pp.11–12) we suggested that one consequence of the decision of the House of Lords in Kuddus v Chief Constable of Leicestershire Constabulary [2001] 2 WLR 1789 is likely to be a ‘gradual expansion of the circumstances in which exemplary damages are awarded’. This prediction has been fulfilled, in part at least, in the recent decision of the Privy Council in A v Bottrill [2002] UKPC 44.
