‘SITE’ IN SECTION 105(2) OF THE HOUSING GRANTS, CONSTRUCTION AND REGENERATION ACT 1996 IS A REFERENCE TO THE WHOLE SITE

In ABB Zantingh Ltd v Zedal Building Services Ltd , Unreported, Technology and Construction Court, 12 December 2000, Judge Bowsher refused to adopt a narrow construction of the word ‘site’ in s105(2) of the Housing Grants, Construction and Regeneration Act 1996. He held that, in order to make sense of the Act, it is necessary to have regard to the nature of the whole site and ask what is the primary purpose of the whole site.
