A consideration of potential liabilities of ship owners

Since owners cannot avoid liability for the negligent acts of pilots, concerted efforts should be made by shipowners to ensure that their operations are carried out in such a way that when incidents do occur, they would be entitled to apply for a decree of limitation. Yinka Agidee explains.

MOST maritime countries have areas designated as compulsory pilotage districts where ships are not allowed to navigate unless navigated by a pilot licensed in such a country. The rationale for compulsory pilotage would appear to be based on the need for national security and protection of life and property in the ports and harbours of these countries.
