Grievance procedures and breach of trust and confidence

The claimant raised a grievance in response to a formal proposal to change her contract. The defendant’s grievance procedure had three stages. Stage one referred any grievance to the line manager, stage two required dealing with the regional secretary and stage three involved a joint panel. The claimant attempted to pursue the grievance past the initial stages but was invited to further meetings which she did not attend because of stress and the potentially detrimental effect on her health. Due to the frustration of being unable to raise a grievance effectively she resigned and claimed constructive dismissal.
