VWF and the issue of limitation – part 2

The claimant developed symptoms of VWF in the 1990’s but had not issued proceedings until April 2004. The defendants argued the issue of limitation and the trial Judge held that for the purposes of the Act he would have acquired knowledge by July 2000, which was when his doctor confirmed to him that he was suffering from VWF. However, in this case the trial Judge chose to apply the discretion given to the court under s33 of the Act and allowed his claim to continue. The defendants appealed.
