Loss of liberty is form of special damage

Loss of liberty was a form of special damage capable of supporting a claim for misfeasance in public office if the other ingredients of the tort were made out. Where a prisoner was moved from an open prison to a closed prison, the residual loss of liberty suffered amounted to a form of special or material damage.
