Lack of second medical opinion

A former employee of a dairy in Jersey has received £11,000 in compensation for unfair dismissal. An employment tribunal said that the man was unfairly dismissed on the grounds of physical incapacity. The tribunal said that a second medical opinion should have been sought after a doctor said the man’s back injury meant he could no longer do his job lifting sacks. He was dismissed as a result. A later report from another doctor contradicted the first medical report.
