‘Loss of earnings’ inadequate

A report from the Economic & Social Research Council argues that the current level of damages for loss of earnings is inadequate, and that a US-style approach would raise these by 25%. US courts take more account of labour market information, such as the way earnings change over a lifetime and the likelihood of an individual’s future employment.
