Exceptional cases only for second appeals

It was only in an exceptional case that permission to appeal would be granted for a second appeal. Where the appeal raised an important point of principle or practice that had not yet been determined, permission could be given under rule 52.13(2)(a) of the Civil Procedure Rules but permission should be refused if the ground of appeal relied upon was that an established principle or practice had not been correctly applied.
