Common-law action not barred by unfair dismissal claim

Where an employer had acted unfairly towards an employee in such a way that the employee had acquired a cause of action at common law prior to and independently of his subsequent unfair dismissal, his common-law action was not barred due to the existence of his statutory unfair dismissal claim.
