Adequate system of inspection and maintenance

The case involved a claim for personal injuries after a trip on a pavement maintained by the defendant. The Claimant alleged negligence and breach of statutory duty under the Highways Act 1980. The claim was defended under s.58 of the Act on the grounds that there was an appropriate and adequate system of inspection and maintenance in place.
