Appeal to go back to tribunal

In a case where a claimant was refused a full hearing by the Employment Appeal Tribunal at a preliminary stage, but was then granted permission by the Court of Appeal to appeal on procedural and practice grounds which the respondent sought to challenge, the Court of Appeal ruled that it has the right to order the appeal to go back to the Employment Appeal Tribunal for a full hearing. The case involved a claim for racial discrimination.
