Breach of the duty of fair presentation

Cometsambre SA v Lloyd's Insurance Co SA HIG 5321 [2026] EWHC 1837 (Comm)

Butcher J, sitting in the Commercial Court, held that Lloyd's was entitled to avoid a charterers' liability and freight and demurrage policy on the basis that Cometsambre had breached its duty of fair presentation of risk under the Insurance Act 2015. The case represents a useful addition to the growing body of case law on the interpretation of the Insurance Act 2015.
