In Owners Corporation 1 Plan No PS 650567Y v Shangri-La Construction Pty Ltd [2026] VSC 117 Delany J in the Victoria Supreme Court ruled that a claims made and notified policy did not protect the assured's managing director who was also a co-assured under the policy. That was because no claim had been made against the managing director within the policy period, and the liability incurred by the managing director did not fall within the insuring clause.
