Adjudication – Alleged excess of jurisdiction and breach of natural justice – Adjudicator entitled to reject case put forward by both parties

The claimant brought the present action in order to enforce the decision of an adjudicator but the defendant sought to resist enforcement on the ground that the adjudicator had acted in excess of his jurisdiction and had breached the principles of natural justice in a material respect. Constable J rejected the defences relied upon by the defendant and held that the claimant was entitled to succeed in its application for summary judgment.
