[2026] EWHC 1761 (Comm), King's Bench Division, Commercial Court, Peter MacDonald Eggers KC sitting as a Deputy Judge of the High Court, 14 July 2026
Procedure – Charterers having successfully appealed an arbitral award for demurrage – Part of delay at discharge port allegedly owing to fumigation at load port – Owners seeking remission to tribunal to claim demurrage on ground of fumigation delay – Owners not having appealed under section 69 of the Arbitration Act 1996 – Owners not having filed a respondent's notice applying for the award to be upheld on alternative ground
In an earlier decision ([2026] EWHC 950 (Comm)), the judge rejected owners' demurrage claim, when the charterers' appeal was
successful on the ground that the invalid notice of readiness had not been waived.
