A case decided earlier in 2026 indicates that problems will almost certainly arise even after the implementation of the new DoLS regime following the Supreme Court's comprehensive demolition of the Cheshire West and Chester Council v P [2014] UKSC 19 judgment in A Reference by the Attorney General for Northern Ireland of a devolution issue under para 34 of Schedule 10 to the Northern Ireland Act 1998 [2026] UKSC 16.
