Fraud in Personal Injury claims

AXA Insurance plc v Maher [2026] EWHC 1365 (KB)

The stance taken by the courts over recent years is a good indication that they are prepared to take seriously fraudulent attempts too boost the level of damages awarded from claimants who have sustained personal injuries. Claimants who are found to have been fraudulent can face a heavy penalty in costs. However, more complex factors can be involved, and it can be difficult to challenge findings of fact made by the judge hearing a case.
