Fuel leaks and strict liability

Privy Council decision highlights the potential for increased exposure for businesses and their liability insurers in claims involving dangerous substance escapes

IN RUBIS Bahamas Ltd v Russell [2026], the Privy Council applied the principle in Rylands v Fletcher (1868) to modern circumstances, determining liability for contamination caused by a fuel leak from a leased petrol station.
