Implications of the Mazur appeal on the conduct of litigation
The Court of Appeal has provided some clarity on the distinction between ‘carrying on’ the conduct of litigation and performing tasks in support of it
SECTIONS 12 and 13 of the UK’s Legal Services Act 2007 (LSA) provide that “the conduct of litigation” is a “reserved legal
activity” which only an “authorised person” can “carry on” (unless exempt — not relevant to this article). Pursuant to sections
14 to 16 LSA, it is a criminal offence for a person to “carry on” a reserved legal activity without being entitled to do so.
