What amounts to reasonable notice?

The Privy Council, in Anheuser-Busch International Inc v Commonwealth Brewery Ltd [2026] UKPC 8, gave consideration to the approach which a court should take when deciding what constitutes a reasonable period of notice when seeking to terminate a contract. The particular context for the case was the termination of a distributorship agreement and some of the factors identified by the court have particular resonance for contracts of that type. But some of the other factors identified by the court have a wider application and may therefore include construction contracts. To this extent, it is worth noting the range of factors which were taken into account when deciding that, on the facts, a reasonable period of notice had been given.
