Claim for psychiatric injury by relative of victim of clinical negligence

The High Court has recently considered what constitutes an "accident" in the context of clinical negligence. In 2024, the Supreme Court had set out clear parameters of liability for psychiatric injury sustained by relatives who had witnessed the death of a loved-one caused by clinical negligence. The key consideration in such cases is whether the death was caused by an "accident", and what is meant by that term.
