Cargo interests' responsibilities in respect of cargo

A Not to ship dangerous cargo without consent

5.1 There is an obligation at common law and under the Hague Rules not to ship dangerous cargo without the informed consent of the carrier (Brass v. Maintland (1856) 6 E&B 470; The Athanasia Comninos [1990] 1 Lloyd’s Rep. 277). There may be express obligations in relation to the suitability of the cargo for shipment in the contract of carriage. Shippers also have statutory duties under instruments such as the International Maritime Solid Bulk Cargoes Code (IMSBC Code) to ensure the safety of cargoes for shipment.
