Adjudication and freezing orders

In High Tech Construction Ltd v WLP Trading and Marketing Ltd [2025] EWHC 3209 (TCC); [2026] BLR 103, Constable J held that the claimant was entitled to the continuation of a freezing order in order to preserve the assets of the defendant pending enforcement of the decision of an adjudicator in the claimant's favour. The claimant had a good arguable case, the evidence was held to establish that there was a real risk that a judgment to enforce the decision of the adjudicator would go unsatisfied by reason of the defendant disposing of its assets unless an injunction was granted and it was found to be just and convenient to grant the order. The case illustrates the useful role that freezing orders can play in ensuring that decisions reached by adjudicators can be effectively enforced and given effect.
