Adjudication – Enforcement – Identity of parties to adjudication – Whether adjudicator had jurisdiction

The claimant, Darchem Engineering Ltd, sought to enforce the decision of an adjudicator. The defendant sought to resist enforcement on the ground that the claimant was not a party to the subcontract under which the dispute had been referred to adjudication with the consequence that it had not been entitled to refer the dispute to adjudication so that the adjudicator lacked jurisdiction to decide the dispute which had been referred to him. The adjudicator had decided that the defendant must pay to the claimant the sum of £23,994, 012.
