CHAPTER 1

General Principles

1.1 Introduction

It is suggested that a ship must be fit to encounter the ordinary perils of the sea as would be reasonably foreseeable and other incidental risks to which it is exposed during the voyage. Under circumstances such as COVID-19, a ship needs to be quarantined or isolated at anchorage if her crew is affected. Hence, it is crucial for the parties involved to provide in their contract how losses from delays due to such causes are to be allocated between them.1
