CHAPTER 7

Interlocutory

This chapter and the next will focus on the “interlocutory” stage of an arbitration, that is, the stage whereby the parties prepare their respective cases for presentation at a substantive merits hearing or trial. At the substantive hearing, the parties will present evidence and arguments in support of their case and against the opposing side's contentions. This chapter will focus on the typical applications to the tribunal that parties mount during the interlocutory stage to assist their preparations for the substantive hearing. The next chapter will consider how the tribunal and parties deal with the collection of evidence during the interlocutory period. The discussion in this chapter will begin with a consideration of interim measures. It will then proceed to a survey of other common interlocutory applications.
