FIDIC lump sum contract – Variations – Condition precedent – Waiver and estoppel

The claimant sought to recover payment in respect of what it said were four additional items of work on a construction project. The claimant's case was that it had been instructed to carry out these works by the Engineer and that they amounted to variations of the contract which entitled it to additional payment. The Privy Council, in a judgment given by Sir Peter Coulson, dismissed the claims.
