HIGH TECH CONSTRUCTION LTD v WLP TRADING AND MARKETING LTD

Adjudication – Enforcement – Formation of contract – Jurisdiction of adjudicator

The claimant applied for summary judgment in order to enforce the decision of an adjudicator. The defendant sought to resist enforcement on the ground that the contract concluded between the parties was not "the genuine agreement between the parties". The claimant's case was that the works had been carried out under a JCT Design and Build Sub-Contract Agreement which was concluded between the parties on 26 January 2023. The defendant denied the existence of any such contract and maintained that the contractual arrangement, as relied upon by the claimant, was "a sham and fraudulent", a stance which it also took before the adjudicator in challenging his jurisdiction to decide the matter which had been referred to him.
