No duty of care in combat

There is no duty for the Ministry of Defence to maintain a safe system of work for service personnel when they are in combat situations. The court therefore dismissed the claims for damages by former service personnel, who had alleged that they sustained psychiatric injury caused by the stress of combat between 1969 and 1996. The 2,000 claimants argued that the Ministry of Defence had been negligent in failing to prevent the psychiatric injuries, and in failing to treat the injuries.
