Payment-in means liable to costs

The acceptance of a payment into court which exceeded a settlement offer did not absolve the defendant from its liability to costs. The court dismissed an application from an airline for an order that it did not have to pay costs. At issue was a conflict between the Warsaw Convention and the Civil Liability Rules, but the court ruled that there was no such conflict. It added that the fact that procedural rules might conflict did not mean that where there was no conflict, the court could ignore them.
