Liability insurance: Third Parties (Rights Against Insurers) Act 2010

In Archer v R 'n' F Catering Ltd (t/a Biplob Restaurant) and Another [2025] EWHC 1342 (KB) HHJ Emma Kelly discussed preliminary issues based on assumed facts relating to the operation of the Third Parties (Rights Against Insurers) Act 2010 where the assured had, prior to becoming insolvent, failed to cooperate with the claims provisions in the policy. The court ruled that the 2010 Act was not as generous as might have been thought in disapplying claims conditions where a claim was made by a third party.
