Arbitration - CIF contract - Error of law - Effect of alleged failure by seller to obtain effective insurance - Criteria for the grant of permission to appeal - Arbitration Act 1996, section 69

By a contract of sale dated 3 May 2021 the claimant agreed to sell 17,000 mt of Brazilian soyabeans to the defendant on CIF terms, for delivery at Aliaga, Turkey. The vessel arrived on 9 May 2021, and it was there noted that the cargo was in a damaged condition. The claimant had not obtained the insurance certificate for the voyage, contrary to the standard requirements of a CIF contract.
