Limiting amount of claim allowed

Both parties involved in a road traffic accident had sustained damage to vehicles and disputed liability. Their insurers agreed to let the court decide liability to decide allocation of repair costs. The claimant paid an insurance excess of £125, and brought an action to recover the amount. He was ordered by the judge to increase his claim to reflect the full amount of his loss. He refused and the claim was struck out.
