Psychiatric injury can be claimed

Under the Civil Aviation Act 1982, claims for psychiatric injury were recoverable as material loss or damage under the Civil Aviation Act 1982. The case involved a claim for damages for personal injury, loss and damage by residents of a village near the crash site of an aircraft. At issue was whether material loss or damage, as referred to in the Civil Aviation Act 1982, was limited to physical loss or damage or whether it included psychiatric injury.
