Sex discrimination must be established

The burden of establishing sex discrimination through a disparity in the rate of pay at an employment tribunal lay with the complainant. The Court of Appeal dismissed an appeal by a female employee who had claimed she had been discriminated against by a disparity in the rate of her pay on the basis of her sex.
