Winson Oil Trading Pte Ltd v United Overseas Bank Ltd (The "Maersk Katalin") [2025] SGCA 42

Rights of bill of lading holders and damages caused by misdelivery

In The Maersk Katalin the Singapore High Court found for the claimant bank against the defendant shipowners for misdelivery. In the present appeal the Singapore Court of Appeal affirmed that the appellant shipowners faced insurmountable factual and legal obstacles in the pursuit of the argument that the bank did not regard the original bills of lading as having any legal effect and hence did not acquire any rights thereunder.
