Personal Injury Compensation
Reliability of evidence given by minors in RTA claims
WM and EW v Wilkinson [2025] EWHC 2300 (KB)
Decisions on the facts concerning precise details of road traffic accidents are heavily dependent on witnesses statements,
and if a claim reaches court may years after the event, it can be difficult for witnesses of fact to recall exactly what they
saw and heard. In a very sad recently reported case concerning an allegation of negligent driving, the event in question occurred
in February 2014, but the case was not heard until July 2025 with judgment handed down on 9 September 2025. The trial was
solely focused on liability.
