"Notified sum" and true value adjudications

In VMA Services Ltd v Project One London Ltd [2025] EWHC 1815 (TCC) Mr Adrian Williamson KC, sitting as a Deputy Judge of the High Court, held that the claimant was entitled to enforce the decision of the adjudicator. The adjudicator had found that the notified sum was due to the claimant and this had the consequence that the defendant was not entitled to refer to adjudication a true value adjudication when the notified sum had not been paid. It was further held that this was an exceptional case where the claimant, as the respondent to the adjudication, was entitled to a monetary award in its favour. The adjudicator had jurisdiction to make such an award because of his finding that the notified sum was immediately due to the claimant and both parties were obliged to comply with that decision.
