Knowledge and "reasonable search" in the duty of fair presentation

Following the prolonged detainment of Win Win and the vessel's subsequent designation as a constructive total loss (CTL) under a war risks policy, the vessel interests were successful in their claim against insurers before the judge. The Court of Appeal rejected the appeal. The judgment considers the duty of fair presentation under the Insurance Act 2015 and the interpretation of detention clauses.
