Validity of application for interim payment – Payment on account and sum claimed less than entitled to claim – Provisional nature of application

The claimant brought the present proceedings in which it challenged the validity of an interim payment application by the defendant. The defendant's notice stated that the "total payment now due" was £341,854.32 but requested payment "on account of £100,000" pending agreement of the final account. The claimant challenged the validity of the notice on a number of grounds.
