Building Safety Act 2022 – Recovery of service charge from leaseholders – Retrospective effect – Human rights

The issue before the Court of Appeal was whether the Building Safety Act 2022 ("the Act") prevented the appellant from recovering service charges from tenants of a building which it owned, in respect of certain costs which it had incurred in remediating defects in buildings before the relevant provisions of the Act came into force on 28 June 2022.
