Liability for rugby injuries

Clark v Elbanna [2025] EWCA Civ 776

The Court of Appeal has recently published its judgment in an appeal from the High Court concerning a claim for damages by a rugby player who had sustained very serious injuries during a match. The court applied the basic principles of negligence and considered what test should be used to determine whether there had been a breach of the duty of care in negligence in the context of what is a notoriously rough sport.
