REGIONAL REPORT: RECENT DEVELOPMENTS AND EMERGING TRENDS IN GREEK CONSTRUCTION LAW

The purpose of this report is to present some of the most notable developments in the field of construction law that have taken place in Greece during the past years. This report focuses on recent legislative changes such as the adoption of the Public Procurement Contracts 
law and examines updates in the legal framework for tall buildings in parallel with its implementation in the Ellinikon project, currently 
underway, the introduction of Early Contractor’s Involvement strategy in construction contracts, and other aspects, such as arbitration clauses 
in concession contracts.

Greece’s Existing Legal Framework for 
Tall Buildings and the Effect of 
THE ELLINIKON PROJECT

The present chapter examines the applicable legislative framework governing tall buildings in Greece, with a focus on the recent trend of construction projects (including tall structures) forming the spearhead of State initiatives for investment and infrastructure development. This chapter will focus on the landmark case of the Ellinikon Project currently under development and its impact on the national legal status quo.
Greece’s major cities are known for their abundance of historical sites neatly blended into an urban background. Taking the example of Athens, the country’s capital and largest by size urban centre, what is evidently missing is the existence of tall buildings.
Historically, Athens has prioritised a landscape characterised by lower building heights, primarily to prevent overshadowing the Acropolis, the site of the Parthenon,1 and other sites of archaeological interest. Apart from any environmental considerations or previous practice, such concerns about
