Clean up costs not damages

An appeal court in California has upheld a ruling that San Diego county should not be indemnified for the costs incurred in an environmental clean-up by ACE Property & Casualty. The ruling held that the insurance policy defined damages as sums ordered by a court. The county had been issued with a clean-up order by the regional water quality board, and had not challenged that order in court.
